Terms and Conditions

These terms govern your use of Orpeca. Please read the automated-results and recovery limitations carefully.

1. Agreement and eligibility

By creating an account, purchasing a subscription, or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. You must be legally able to enter this agreement and be at least 13 years old. If you use the service for an organization, you represent that you may bind it.

2. Automated results are not guaranteed

Orpeca may scan, extract, classify, summarize, match, organize, search, recommend folders, identify missing items, and generate Packet or other results using software and on-device models. These results may be incorrect, incomplete, duplicated, outdated, misleading, or unavailable. We do not guarantee their accuracy, completeness, suitability, or reliability.

You must check generated results against the original document and correct important information yourself. The service does not provide legal, tax, accounting, medical, immigration, financial, insurance, or other professional advice. Do not rely on it to determine eligibility, satisfy a filing requirement, calculate an amount, meet a deadline, preserve evidence, or make a high-impact decision. Consult a qualified professional where appropriate.

3. Your vault, account, and security

You are responsible for information you import, the accuracy of your account information, and activity performed through your trusted devices and account. Protect device passcodes, account credentials, recovery methods, exports, and shared copies. Notify us promptly of suspected unauthorized access.

The service is designed so we do not possess the keys needed to read your document content. That privacy boundary also means we may be unable to restore documents if all trusted devices, recovery keys, and encrypted backups are lost or unavailable.

4. Storage, backup, and availability

Local data remains your responsibility. Encrypted sync and recovery are convenience and resilience features, not an archival, records management, or guaranteed backup service. Keep independent copies of records you cannot replace. We do not guarantee uninterrupted access, successful synchronization, permanent retention, or recovery from every hardware, provider, network, software, or user error.

5. Sharing

Only share documents with people you intend to authorize. You are responsible for selecting recipients and roles and for having the right to share the material. A recipient may save, export, screenshot, or otherwise retain information before access is revoked. Revocation prevents future service access but cannot erase copies already outside our control.

6. Acceptable use

You may not use the service to:

  • violate law, privacy, confidentiality, or intellectual-property rights;
  • upload or share material you lack authority to use;
  • harm, deceive, harass, exploit, or impersonate another person;
  • circumvent security, quotas, billing, access controls, or technical limits;
  • probe, disrupt, overload, reverse engineer, or misuse the service except where law expressly permits; or
  • distribute malware or use the service for unauthorized surveillance or automated abuse.

7. Plans, subscriptions, and Apple billing

Paid iOS subscriptions are purchased through Apple and renew automatically unless cancelled through your Apple account at least as required by Apple before renewal. Apple handles billing, cancellations, and refunds under its terms. Deleting your Orpeca account or the app does not automatically cancel an Apple subscription. Features and limits may differ by plan and may change with notice.

8. Ownership and license

You retain rights in your documents. You grant us only the limited rights needed to operate the service on encrypted data and control-plane metadata. We and our licensors retain rights in the application, website, branding, design, and software. Subject to these Terms, we grant you a personal, limited, revocable, non-transferable license to use the service.

9. Suspension, termination, and changes

You may stop using the service and delete your account. We may suspend or terminate access when reasonably necessary to prevent harm, comply with law, address nonpayment, or enforce these Terms. We may update or discontinue features. Where practical, we will provide notice of material changes that adversely affect paid use.

10. Disclaimers and liability

To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, availability, fitness for a particular purpose, non-infringement, or data recovery. Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, documents, revenue, opportunity, or deadlines; decisions made from generated results; or acts of recipients and third-party providers. Our aggregate liability relating to the service will not exceed the greater of the amount you paid us through Apple for the service during the previous 12 months or CAD $100. This limitation does not apply where prohibited by law.

11. General terms

Applicable consumer protections remain in force. If one provision is unenforceable, the rest remain effective. A failure to enforce a term is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger, financing, reorganization, or sale of the service, subject to applicable law.
